Acceptance of Terms

By installing and using the SendIQ Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Eligibility

To use SendIQ, you must:

• Be at least 13 years of age
• Possess a valid Gmail account
• Have the legal capacity to enter into agreements
• Comply with all applicable laws and regulations

If you are under 18, you must have parental or guardian consent to use the Service.

Gmail Access and User Responsibilities

OAuth Authentication: SendIQ requires access to your Gmail account through Google's OAuth 2.0 protocol. By using the Service, you grant SendIQ permission to:

• Access your Gmail account with the specified OAuth scopes
• Send emails on your behalf using Gmail's API
• Modify your Gmail as necessary for email operations
• Receive basic account information (email address and display name) for authentication purposes

Account Information Collection: During the OAuth process, SendIQ may receive your Gmail email address and display name. This information is used solely for:

• Verifying your identity and authenticating your account
• Personalizing your experience within the extension
• Ensuring secure access to your Gmail account

User Responsibility: You are solely responsible for:

• All emails sent through SendIQ using your account
• Maintaining the security of your Gmail credentials
• Ensuring compliance with Gmail's terms of service
• Obtaining necessary permissions for any recipients
• Providing accurate account information during authentication

SendIQ acts as an intermediary and cannot be held responsible for the content or delivery of emails sent through your account.

Prohibited Use

You agree NOT to use SendSmart for:

• Spam or Unsolicited Emails: Sending bulk emails without recipient consent
• Phishing or Fraud: Attempting to deceive recipients or steal information
• Illegal Content: Sending emails containing illegal, harmful, or inappropriate material
• Harassment: Using the Service to harass, threaten, or intimidate others
• Commercial Abuse: Sending unsolicited commercial emails in violation of CAN-SPAM laws
• System Abuse: Attempting to overload or disrupt email systems

Violation of these prohibitions may result in immediate termination of your access to the Service and may be reported to appropriate authorities.

Service Availability and Limitations

Service Availability: SendIQ is provided "as-is" and "as-available." We do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all Gmail configurations
• Delivery of emails to all recipients
• Specific delivery times for scheduled emails

Rate Limits: The Service is subject to Gmail API rate limits and restrictions. We are not responsible for any delays or failures due to these limitations.

Limitation of Liability

To the maximum extent permitted by law, SendIQ and its developers shall not be liable for:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from email delivery failures
• Security breaches or unauthorized access to your account
• Any third-party actions or content

Our total liability shall not exceed the amount you paid for the Service (if any) in the 12 months preceding the claim.

Intellectual Property

SendIQ Ownership: The Service, including all software, code, design, branding, logos, and content, is owned by SendIQ and protected by intellectual property laws.

User License: We grant you a limited, non-exclusive, non-transferable license to use SendIQ for its intended purpose. You may not:

• Copy, modify, or reverse engineer the Service
• Distribute or redistribute the extension
• Use SendIQ branding or logos without permission
• Create derivative works based on the Service

Privacy and Data Protection

Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SendIQ, you consent to the collection and use of information as described in our Privacy Policy.

Termination

User Termination: You may stop using SendIQ at any time by removing the extension from your browser.

Service Termination: We may terminate or suspend your access to SendIQ at any time, with or without notice, for:

• Violation of these Terms
• Abuse of the Service
• Illegal or harmful activities
• At our sole discretion for any reason

Upon termination, your right to use SendIQ ceases immediately.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction where SendIQ operates.

Any disputes arising from these Terms or your use of SendIQ shall be resolved through binding arbitration or in the appropriate courts of jurisdiction.

Changes to Terms
